Pandora's papers: How the world of maritime finances is still thriving(part-5)

You know, when you talk to him, he's a really decent person. The Asiaciti office in Samoa has come up with a new product that pays well.

It was introduced as a Samoan superannuation program. Briggs wrote to Gould explaining how it works.

"Western Samoa does not have a tax treaty with Australia,"

so it provides "complete exemption" from all forms of income tax "and provides" complete secrecy and privacy. "Gould has invested his clients' money in large Asiaciti funds offshore.

The reason is, in fact, their office has provided all the support staff. So, they set up a big bag. Get the attorneys to prepare the titles.

They get everything done. They knew, you know, they were part of this transaction. Samoa's largest bird scheme TWITTER Asiaciti had a good distortion.

Customers are able to get their money back before retirement with a loan from a super fund.

ANTHONY WATSON: The tax temptation, if you want to avoid it, to establish a Samoan fund, make your employer pay a certain amount of money for it, and then the income of the Samoan fund, the idea that it could be tax-free in Australia.

Therefore, the fund's income can be earned tax-free in Samoa. But if you want to return it to Australia, however, we had rules, like all big money, that if you got paid for death, disability, age attainment, or retirement, you were taxed on it.

Therefore, the answer is not getting paid for any of those reasons, instead, get a loan. Loans on any type of tax are tax-free.

Therefore, if I lend you money, you are not taxing the money I am giving you. It is not income. Not again.
You did not earn anything, you just borrowed from me.

So, in this case, they are simply ... the Samoan fund will borrow money from an Australian resident. But the Tax Office had some questions about Samoa's major projects.

In 2010 it issued a public warning that these schemes were used to conceal income or assets and that so-called loans to them would be absurd.

WILL DAY: What we can do in that kind of arrangement is to ask some questions - "Not if this is really a commercial loan,"

For example,
"Where are the documents that remain behind that loan?"
"How much interest is paid?"
"Show us where your payments are going."
"Why did you plant that?"

And often, when these arrangements are not commercial, they cannot answer those kinds of questions. The taxpayer's notice is like a siren that says,

"We are watching." It has not changed the law.

The taxpayer's notice simply indicates that the Tax Office is aware that certain people are doing certain things.

Gould's charges of tax evasion were eventually dropped, but he was later arrested for perverting the course of justice by training a witness to lie.

Gould's customers have been ordered to pay more than $ 300 million to ATO. My job is to help taxpayers get past the Australian Tax Act labyrinth in a very effective way.

And if one of the most effective ways is to reduce their taxes, well ... well, then so be it. I don’t think there are any morals in it.

Leaked documents show that Graeme Briggs was investigated by Australian authorities while investigating Vanda Gould's activities in Samoa.

Briggs was not charged or charged with criminal misconduct. Vanda Gould still supports him.

No, I mean, I don't have strong feelings against ... against, you know, Graeme. But ... you know, just look at this space.

God will eventually fight for me. I think the first thing to remember is that most people do the right thing, and there is nothing illegally reserved for money at sea as long as the Tax Office is announced, and most people are doing the right thing.

While Graeme Briggs has retired from his speed outside Melbourne, Asiaciti continues to do business at tax centers around the world.

In a statement, Asiaciti said: The problem with the overseas country is that it is up to the service providers to regulate it.

Some laws are imposed by governments, but no government directs them. There is no sheriff here.

And, therefore, where you live in this kind of the same environment where there is no government oversight you can talk about, these firms must follow the rules.

In 2016 the first leak of the Panama Papers provoked international outrage over seawater coverage.

The provincial government is committed to registering beneficial ownership, which will compel the true owners of business entities to be disclosed. It still hasn't happened.

PETER WHISH-WILSON: We have been campaigning for five years now to get a register of owners who benefit the community.

Australians have a right to know who buys their land, their royal treasures, their future? I will not go into any debate about whether foreign investment is good or bad, but, hell hell, our laws should be good.

Accountants and attorneys who make a lot of set-ups, many of these categories, of illegal funds do not need to provide information to the nearest regulator and who is the ultimate owner of this information.

There is no real reason for that, except that these industries, such as accounting and legal work, they have angrily pleaded in Canberra.

This saves time to set up a register of beneficial ownership, and therefore, undermines the efforts of Australian partners to link the problem and diagnose the problem.

But what happens is, if you allow the trend to continue and allow the world to be ... a destination for illicit wealth that buys land, buys houses and land.

When it begins to be a place of crime and sickness Money is born, there is a question of what other problems do you bring with you?

Will it just be money? Because it has never been just money. It is estimated that one-tenth of the world's wealth is stored in overseas financial institutions, costing governments billions of dollars in lost tax revenue each year.

There are growing calls for Australia to tighten regulations ruling this same world.

NATHAN LYNCH: We are sadly behind time.

Therefore, for all members of the world's financial services staff who do not comply with all obligations made to porters - by the US, China, and then to countries such as Madagascar - and then to that list, you have Australia.

So, we threw the ball in this place. WILL DAY: Look, most lawyers, accountants, and other professionals do the right thing.

It is very easy to be tempted to participate in maritime tax programs. My message to them does not make it easy to lie, cheat and steal from other Australians.

You will soon find yourself over your head in these arrangements. They are not wise. They are harmless. They harass the entire Australian community.
